1. Agreement to Terms
By accessing or using QR-Rescue ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.
QR-Rescue is operated from Victoria, Australia. These terms are governed by the laws of Victoria and the Commonwealth of Australia, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
2. Our Services
QR-Rescue provides custom-printed QR code tags, stickers, and labels designed to help reunite lost items with their owners. Our service includes:
- Custom QR tag design and printing
- Secure online account to manage your tags
- Privacy Proxy messaging system to protect your personal details
- Notification when someone scans your tag
You are responsible for ensuring that the contact information in your account is accurate and up-to-date so that you can receive notifications if your items are found.
3. Orders and Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include GST where applicable. We currently only ship to addresses within Australia. Shipping costs are calculated at checkout and vary based on your location.
Once you place an order, you will receive an email confirmation. We aim to dispatch orders within 2-5 business days. Delivery timeframes depend on your location and the shipping method selected.
4. Consumer Guarantees
Your Rights Under Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
We guarantee that our products will:
- Be of acceptable quality (safe, durable, free from defects)
- Match the description and images shown on our website
- Be fit for the purpose of identifying lost items via QR scanning
- Have QR codes that correctly link to your account
5. Returns and Refunds
Faulty or Damaged Products
If your product arrives damaged, defective, or does not match your order, please contact us within 30 days of delivery at support@qr-rescue.com.au with:
- Your order number
- Photos of the issue
- Description of the problem
We will provide a replacement or full refund at no additional cost to you, including return shipping if we request the item be returned.
Change of Mind
As our QR tags are custom-printed with unique identifiers linked to your account, we are unable to accept returns for change of mind. Each tag is manufactured specifically for you and cannot be resold or reused. This does not affect your statutory rights under Australian Consumer Law.
6. Accounts and Security
When you create an account, you are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these terms or are used for unlawful purposes.
7. Limitation of Liability
QR-Rescue is a facilitating platform designed to increase the chances of reuniting lost items with their owners. We guarantee the functionality of our QR codes and messaging system, but we cannot guarantee the recovery of any lost item.
The recovery of lost items depends on:
- Someone finding the item
- The finder choosing to scan the QR code
- The finder choosing to send a message
- Your response to the notification
To the maximum extent permitted by law, we exclude liability for any indirect, incidental, or consequential damages arising from the use of our service, including the loss of items or the failure to recover lost items.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
8. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of QR-Rescue or its licensors and is protected by Australian and international copyright laws.
You may not reproduce, distribute, or create derivative works from our content without our written permission.
9. Acceptable Use
You agree not to use our service to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm others
- Send spam or fraudulent messages through our system
- Attempt to access other users' accounts
- Interfere with the operation of our service
We reserve the right to terminate access for users who violate these provisions.
10. Disputes
If you have a complaint or dispute, please contact us first atsupport@qr-rescue.com.au. We will endeavour to resolve any issues promptly and fairly.
If we cannot resolve the dispute, you may contactConsumer Affairs Victoria or seek resolution through the Victorian Civil and Administrative Tribunal (VCAT).
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes by email or by posting a prominent notice on our website. Your continued use of the service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria.
